Old North State Report – February 15, 2019

 

NC Department of Health and Human Services Secretary Mandy Cohen appeared before the NC House Health Policy Committee on Tuesday to provide an update on the state’s transition to a privatized Medicaid system.  Also referred to as Medicaid managed care, the legislation mandating that Medicaid be handed over to insurers became state law back in 2015.  Last week, DHHS officially announced the five health insurers selected to take over the state’s Medicaid health program. Four statewide contracts, and one regional, were awarded following a rigorous RFP procurement process.  AmeriHealth Caritas, Blue Cross and Blue Shield, UnitedHealthcare, and WellCare received statewide contracts, while the sole regional award went to Carolina Complete Health.  In her remarks to the committee, Cohen said challenges to the contract awards are expected, specifically in the case of Aetna whose proposal was only 2.06 points below a contract winner.  My Health by Health Providers, a Morrisville-based consortium of 12 NC hospitals did not receive a contract and has already announced plans for an appeal.  The Secretary went on to say that the Department will move forward with the transformation effort and that appeals will be handled internally by DHHS staff, though they could potentially end up in court.  [see attached article]

 

 

A number of bills have been filed the past two weeks in the House and Senate by both Republicans and Democrats, calling for school calendar flexibility.  The legislation, short titled “School Calendar Flexibility/Certain School Systems,” would provide additional flexibility to certain local Boards of Education in adopting their respective school calendars. As of today, there are 10 local bills filed that would reinstate flexibility of school calendars to the local boards, a control that was taken away by the state in 2004.  County Boards of Commission are passing resolutions as a show of solidarity and support for the effort.  Additional local bills related to school calendar flexibility are expected to be filed in coming days. https://www.the-dispatch.com/news/20190212/county-approves-resolution-in-support-of-school-calendar-flexibility

 

 

A bill was introduced in the House this week that, if passed, will extend the deadline by which certain providers are required to connect to and participate in NC’s Health Information Exchange (HIE) network known as NC HealthConnex.  Representatives Dobson, White, Murphy and Lambeth are the primary sponsors of HB70, “Delay NC HealthConnex for Certain Providers.”  Providers of Medicaid services with an electronic health record system were to begin submitting demographic and clinical data to HealthConnex by June 1 of last year; PHPs once under contract with DHHS, and LME/MCOs by June 1, 2020.  If successful, this legislation will extend the deadline to June 1, 2021 for a number of specific providers detailed by statute. https://www.ncleg.gov/Sessions/2019/Bills/House/PDF/H70v1.pdf

On Monday, the North Carolina Department of Health and Human Services announced the recipients of five Prepaid Health Plan (PHP) contracts for Medicaid managed care.  The four statewide PHP contracts were awarded to AmeriHealth Caritas NC, Inc., Blue Cross and Blue Shield North of Carolina, UnitedHealthcare of NC, Inc., and WellCare of NC, Inc.  One regional contract for Regions 3 and 5 was awarded to Carolina Complete Health, Inc.  This procurement process is part of a legislative plan for Medicaid transformation first approved in 2015.  DHHS will continue to oversee the Medicaid and NC Health Choice programs, while the PHPs will manage certain health services, contract with providers to deliver specific services for beneficiaries, and assume financial risk. This part of the procurement process was for “Standard Plans” only.  “Tailored Plans,” which serve far more complex populations, will be procured later. Reducing the number of assessments administered to North Carolina public school students continues to be a top priority for state education leaders and advocates. In a statement released by NC Department of Public Instruction officials on Wednesday, it was announced that three state exams could be eliminated as part of an ongoing effort to ease the issue of “over-testing” in the state’s public schools.  State Superintendent Mark Johnson is recommending the elimination of the final exams for science in fourth grade and social studies in grades four and five.  The recommendation will now go to the State Board of Education for approval. House Joint Resolution 36 passed the House on Wednesday and is now in Senate Rules.  The Resolution formally invites Governor Roy Cooper to deliver the “State of the State” address to a joint session of the House and Senate.  The Governor’s Cabinet is invited to attend, as are the members of the state Supreme Court. The original Resolution called for the address to be held on February 18th, however this will be amended at the Governor’s request, and the address will be given on Monday, February 25th, at 7:00 p.m.

Even with the Senate not meeting Tuesday the budget process moved forward at high speed, a new Party was established in North Carolina, and a push for increasing minimum wage were the top stories this week in North Carolina State Government.

 

Legislative leaders revealed that the State budget will be rolled out as a conference report, a process which eliminates the ability for legislators to amend the budget bill.  House and Senate negotiators will sign off with the deal being worked out behind closed doors.  Supporters of the process tout efficiency as the driving force for using this process, while critics blasted the lack of transparency and public input.  The budget bill was predicated to pass both houses by the end of the week.  [see N&O story at link]

North Carolina has a new political party.  The Constitution Party acquired the necessary signatures and it will be eligible to be on the ballot this November. [see N&O story at link]

Some legislators are pushing for an increase in the minimum wage in North Carolina.  About one-third of the workforce in the State earn a minimum wage.  Critics of the idea cite that such proposal will cost jobs and stifle economic growth by driving up prices. [see WRAL story at link]

It was another slow week at the General Assembly, which isn’t atypical for the beginning of a long session.

No committee meetings were held and only a handful of bills were dropped into the hopper. Fortunately, or unfortunately (depending on your perspective), there is plenty of time for members to introduce legislation according to this year’s deadlines:

A December 2016 effort to repeal the measure ultimately collapsed amid accusations and top Republican leaders say that any repeal effort this year would likely involve a compromise where local governments would be limited in their ability to approve new LGBT protections. Democrats argue a clean repeal is both preferable and possible.

Another partisan fight is brewing over who has the authority to sign off on the new governor's Cabinet appointments. Democratic Governor Roy Cooper has announced eight appointments with two more to be named in the coming weeks. The state Constitution conditions a governor's appointments on the "advice and consent" of a majority of the (currently Republican) Senate, although that has not been the previous practice and the Governor is arguing in court that it doesn't include Cabinet appointments.

Until and unless a judge rules otherwise, the Senate is scheduling the vetting process. Observers believe the two most potentially tricky selections are Michael Regan (Department of Environmental Quality) and Mandy Cohen (Department of Health and Human Services). Thus far, the Cooper administration has yet to say if it will comply with the Senate’s request for its nominees to appear and answer questions.

The North Carolina General Assembly formally reconvened on January 11th to re-elect Tim Moore as Speaker of the House and Phil Berger as Senate President Pro Tem. After a two week organizational break, the legislature began to slowly crank back into action this week.

 

Committee chairs have been named in each chamber. A few dozen bills were introduced. No committee meetings were held but they are expected to start next week. The “crossover deadline” (the date non-fiscal bills must pass either the House or Senate to remain eligible for consideration) was announced as April 27th.

 

The recent announcement that state revenue collections are running $322 million ahead of projections might lead some to believe the session will conclude around the beginning of the fiscal year on July 1st. However, long-time observers note a surplus can actually prolong the duration of a legislative session as lawmakers debate how to spend or save extra funds.

 

Add in continued tension over the controversial House Bill 2 from last year (will there be another attempt to compromise on a repeal? will the courts address the issue first? will economic pressure on the state continue?) and the already strained relations between the new Democratic Governor and Republican super-majorities in the legislature…
